CHAPTER 551.
GENERAL PROVISIONS CONCERNING CRIMES AND PUNISHMENTS.
AN ACT in relation to witnesses in behalf of indigent defendants in criminal cases.
Be it enacted by the Senate and House of Representatives of the State of Delaware, in General Assembly met:
SECTION 1. Whenever any person indicted in a court of this State make affidavit setting forth that there are witnesses whose evidence is material to his defence, their names, that he cannot safely go to trial without them what he expects to prove by each of them, that they are within this State and that he is not possessed of sufficient means and is unable to pay the fees of such witnesses, the court in term or any judge thereof in vacation, may order that witnesses be subpoened in such case:, the cost of issuing and serving the process and the fees of the witnesses shall be paid in the same manner that similar cost and fees are paid in case of the witnesses subpoened in behalf of the State.
