AN ACT to Amend Chapter 117 of the Revised Code of the Stale of Delaware by providing a method for Recording Renunciations by Trustees.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

3871, Sec. 28 That Chapter 117 of the Revised Code of the State of Delaware be, and the same is hereby, amended by adding an Amended additional section, to be known as 3871, Sec. 28-b, reading as follows, to wit:

Whenever, by any will, deed or other instrument, a trustee shall be named and before the acceptance of the trust the person or persons, corporation or corporations, or any one renunciation in or more of them named as such trustee or trustees, shall renounce and decline to perform the duties imposed thereby, he, it or they shall make and file in the office of the Register in Chancery of the County where such will, deed or instrument may be probated or recorded, a written renunciation setting forth in general terms the instrument of appointment and that he it or they, has, or have, not accepted the trust or exercised any powers or performed any duties thereunder, and Recorded in Chancery declining to act under such appointment. It shall be the duty docket of the Register in Chancery to record and index such renunciation in the Chancery docket.
