CHAPTER 293 - DELAWARE RACING COMMISSION REDUCING BOND OF COMMISSIONERS
AN ACT TO AMEND CHAPTER 163 OF THE REVISED CODE OF DELAWARE, 1935, AS AMENDED, RELATING TO DELAWARE RACING COMMISSION BY REDUCING THE BOND OF EACH OF THE COMMISSIONERS TO TWENTY-FIVE THOUSAND DOLLARS ($25,000.00); BY PROVIDING FOR THE PAYMENT OF CERTAIN MONIES TO THE STATE OF DELAWARE TO BE TRANSMITTED THROUGH THE DELAWARE RACING COMMISSION.
Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:
Section 1. That Chapter 163 of the Revised Code of Delaware, 1935, as amended, be and the same hereby is further amended by striking out of 5498 Section 3 thereof the following words and figures beginning in line seventeen thereof, to-wit:
"…in the penalty of One Hundred Thousand Dollars ($100,000.00)," and inserting in lieu thereof
"…in the penalty of Twenty-five Thousand Dollars ($25,000.00),"
Section 2. That Chapter 163 of the Revised Code of Delaware, 1935, as amended, be and the same is hereby further amended by striking out and repealing the seventh paragraph of 5510 Section 15 of said Revised Code of Delaware, as amended, reading as follows:
"Every person, association or corporation engaged in the business of conducting a race meeting under this Act shall pay to the Delaware Racing Commission, for the use of the State of Delaware, a sum equal to three and one-half per cent (31/2%) of the total contributions to all pari mutuel and totalizator pools conducted or made on any and every race track licensed under this Act, and on every race at such track."
and inserting in lieu thereof the following:
"Every person, association or corporation engaged in the business of conducting a race meeting under this Act shall pay to the State of Delaware, by certified check to be transmitted to the Delaware Racing Commission, which if found correct by said Commission, shall by said Commission be transmitted to the State Treasurer, a sum equal to three and one-half per cent (31/2%) of the total contributions to all pari mutuel and totalizator pools conducted or made on any and every race track licensed under this Act and on every race at such track."
