CHAPTER 135 - REGISTER OF WILLS--SUSSEX COUNTY COMMISSION TO EXAMINE AND CERTIFY TO CORRECTNESS OF NEW RECORDS

AN ACT AUTHORIZING THE APPOINTMENT OF A COMMISSION TO EXAMINE AND CERTIFY TO THE CORRECTNESS OF NEW RECORDS PREPARED FOR THE OFFICE OF THE REGISTER OF WILLS IN AND FOR SUSSEX COUNTY, DELAWARE, AND TO RECORD SAID CERTIFICATION.

WHEREAS, the General Index to Wills Records, Sussex County, Delaware, in the Office of the Register of Wills has through constant use become torn and defaced;

AND WHEREAS, Administration Accounts No. 3, Register of Wills, Sussex County, Delaware, in the aforementioned Office, has likewise become torn and defaced;

AND WHEREAS, to avoid the loss of any part of said index and record, and the difficulty in deciphering them, and other inconveniences arising from their condition.

NOW, THEREFORE, Be it enacted by the Senate and House of Representative of the State of Delaware in General Assembly met:

That the Judges of the Superior Court, resident in Sussex County, or either of them, are hereby authorized to appoint a Commission of two attorneys, resident in said County, who shall forthwith proceed to examine and compare the new General Index to Wills Records and Administration Accounts No. 3 and to certify, if such shall be the case, that said new records are exact duplicates of the records that have become torn and defaced, which said certification shall be placed on record in the Office of the Recorder of Deeds in and for Sussex County, at Georgetown, Delaware;

Upon the recording of the aforementioned certificate the new General Index to Wills Records and Administration Accounts No. 3 shall become the official records for Sussex County;

The expense of said Commission and of said recording shall be paid by the Board of Trustees of Sussex County.
