CHAPTER 46 - APPROPRIATION - HOWARD B. MONEY CLAIM

AN ACT APPROPRIATING CERTAIN MONIES OUT OF THE STATE TREASURY TO PAY A CLAIM OF HOWARD B. MONEY AGAINST EDEN SCHOOL DISTRICT NO. 101, RELATING TO EXPENSES INCURRED IN CONNECTION WITH REPAIRS TO EDEN SCHOOL BUILDING.

WHEREAS, the Board of School Trustees of Eden School District No. 101 has, during the fiscal year 1944-1945, authorized and procured repairs to Eden School Building at a cost of Six Hundred Dollars and Fifty cents ($600.50);

AND WHEREAS, during the fiscal year 1943-1944 said Board of School Trustees had available, for other purposes, funds totaling Five Hundred and Twenty Dollars ($520.00) which said Board, through certain proceedings, might have had reallocated to take care of necessary repairs;

AND WHEREAS, said Board, believing that such other funds could be used for the purpose of effecting necessary repairs without having the same reallocated for that purpose, inadvertently permitted said funds to revert to the General Fund of the State Treasury;

AND WHEREAS, said Board of School Trustees has available for necessary repairs for the fiscal year 1944-1945 the sum of Eighty Dollars ($80.00) only, and no other funds which can be used to pay the cost of repairs so authorized and procured;

AND WHEREAS, said Board of School Trustees requires that additional funds be made available to pay the claim of Howard B. Money, of Delaware City, for repairs so made;

AND WHEREAS, it appears that an appropriation of a sum equivalent to that which said Board of School Trustees inadvertently permitted to revert to the General Fund of the State Treasury at the close of the fiscal year 1943-1944 is warranted to provide funds for the payment of said claim;

NOW, THEREFORE, Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That the sum of Five Hundred and Twenty Dollars ($520.00) be and the same hereby is appropriated to the State Board of Education for the purpose of paying the claim of Howard B. Money, Delaware City, Delaware, against Eden School District No. 101 for repairs to Eden School Building. The monies appropriated hereunder shall be paid out by the State Treasurer upon voucher or vouchers duly drawn by the State Board of Education and shall be used by the State Board of Education to pay said claim of Howard B. Money.

Section 2. That this Act Shall be taken and deemed to be a Supplementary Appropriation Bill and the money hereby appropriated shall be paid out of the General Fund of the State Treasury not otherwise appropriated.
