CHAPTER 22 - AUTHORIZING STATE BOARD OF EDUCATION TO USE UNEXPENDED FUNDS OF COLORED SCHOOLS

AN ACT TO AUTHORIZE THE STATE BOARD OF EDUCATION TO USE CERTAIN UNEXPENDED MONEYS HERETOFORE APPROPRIATED FOR REPAIRS TO COLORED SCHOOLS UNDER ITS CONTROL.

WHEREAS, The State Legislature in the year 1939 by Chapter 46, Volume 42, Laws of Delaware, appropriated the sum of $76,500.00 "to the State Board of Education to alleviate housing and sewage conditions of the colored schools of the State of Delaware, to be allotted among the colored schools as follows:

Colored School at Newport

$30,000.00

Colored School at Middletown

10,000.00

Colored Schools of Wilmington

30,000.00

Colored School at Bridgeville

6,500.00"

AND WHEREAS, No balance of the $30,000.00 allocated to the Colored Schools of Wilmington stands to the credit of the said colored schools of Wilmington in the accounts of the State Auditor and the State Treasurer; and

WHEREAS, There remains a balance of $3,754.34 in the records of the State Auditor to the credit of the "Colored School Improvement Account" the same being the balance of the aforesaid appropriation of $76,500.00 unspent for the use and benefit of the aforesaid districts; and

WHEREAS, There is serious need of repairs in other colored school districts under the control of the State Board of Education; therefore

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. The said State Board of Education is hereby authorized to use the said balance of $3,754.34 for needed repairs in any colored school of the State of Delaware including the above mentioned schools, but excluding the colored schools of the City of Wilmington, and the same or any part thereof shall not revert to the General Fund on June 30, 1945.

Section 2. The State Auditor is hereby authorized and directed to approve warrants drawn by the State Board of Education upon the said balance of $3,754.34 for the said purpose, and the State Treasurer is hereby directed to pay the said warrants from the said balance to the credit of the said "Colored School Improvement Account."
