AN ACT TO AMEND SUBCHAPTER II OF CHAPTER 55, TITLE 29, DELAWARE CODE, RELATING TO MANDATORY RETIREMENT OF PUBLIC EMPLOYEES.
Be it enacted by the General Assembly of the State of Delaware:
Section 1. Amend §5521(a) of Subchapter II, Chapter 55, Title 29, Delaware Code by striking the period "." immediately following the word "age" as the same appears in the last sentence of said paragraph (a) and insert the following:
"; provided, however, that no public employee who reaches the mandatory retirement age and has less than 12 months to reach maximum pension benefits, who is willing and able to perform his or her duties, shall be terminated from public employment."
