AN ACT TO AMEND CHAPTER 42, VOLUME 53, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT AMENDING, REVISING AND CONSOLIDATING THE CHARTER OF THE CITY OF SEAFORD" RELATING TO THE QUALIFICATIONS FOR MAYOR AND CITY COUNCIL.

Be it enacted by the General Assembly of the State of Delaware [two-thirds of all members elected to each House thereof concurring therein]:

Section 1. Amend Section 5 of Chapter 42, Volume 53, Laws of Delaware as amended by striking subsection (1) in its entirety and substitute in lieu thereof a new subsection (1) to read as follows:

"(1) A bona fide citizen of the United States and of the State of Delaware and a resident freeholder of the City of Seaford for at least one (1) year next preceding the annual election; provided, however, that no full time employee of the City of Seaford shall serve as Mayor or City Councilman during such time as he is a full time employee of the City of Seaford; and".

Section 2. Amend Section 13 of Chapter 42, Volume 53, Laws of Delaware, as amended, by adding thereto a new sentence to read as follows:

"If any Councilman or Mayor, during his term of office shall become a full time employee of the City of Seaford, he shall forthwith be disqualified to act as a member of Council or as Mayor, and his office shall be deemed vacant and shall be filled by Council as provided in this Charter."
