AN ACT TO AMEND CHAPTER 69, TITLE 29, DELAWARE CODE, RELATING TO THE AWARD OF CONTRACTS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §6907, Title 29, Delaware Code, by adding at the end thereof the following:
"In determining how the 'interest of the State shall be better served' the agency may, when there are competitive bids from both in-state and out-of-state vendors or contractors, consider such factors as in-state employment and fees and taxes with regard to bids within two percent of the lowest bid."
