AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO CRIMINAL TRESPASS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two thirds of all members elected to each House thereof concurring therein):

Section 1. Amend Section 823, Subchapter III, Chapter 5, Title II of the Delaware Code by striking said Section in its entirety and substituting in lieu thereof the following:

§823. Criminal trespass in the first deRree; Class A misdemeanors

A person is guilty of criminal trespass In the first degree when he knowingly enters or remains unlawfully in a dwelling or building used to shelter, house, milk, raise, feed, breed, study or exhibit animals.

Criminal trespass in the first degree is a Class A misdemeanor.
