AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE TO EXTEND THE EXISTING REGISTRATION REQUIREMENT FOR EXTREMELY HAZARDOUS SUBSTANCES FROM ONE TO THREE YEARS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §7709, Title 7 of the Delaware Code by striking subsection (a) in

its entirety and substituting in lieu thereof the following:

"(a) Within fourteen (14) months of July 19, 1988, the Department shall prepare a

registration form and shall issue public notice for all persons to register any EHS in an amount equal to or greater than its RQ. Each person shall return the completed registration form and the fee, if required, to the Department within sixty (60) days of the issuance of the notice and once every three(3) years thereafter, and attest compliance with the provisions of this chapter and its regulations. If at any time after the submission of the registration, information in the registration is no longer accurate, the owner or operator shall submit an amended notice within sixty (60) days to the Department.".
