AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO JUROR MISCONDUCT.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Title 11, Delaware Code, § 1267 by striking the current section and replacing it as follows:

"A person is guilty of misconduct by a juror when, in relation to an official proceeding pending or about to be brought before the juror:

(1) the juror agrees to give a vote, opinion, judgment decision or report for or against any party to the action or proceeding, or

(2) the juror solicits, negotiates, accepts, or agrees to accept any payment or benefit for himself or for a third person in consideration for supplying any information depicting the juror's service.

For purposes of this section, a juror shall be any person who has received notice of summons to appear for jury service.

Misconduct by a juror is a Class A misdemeanor."
