AN ACT TO AMEND AN ACT BEING CHAPTER 326, VOLUME 71, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT TO REINCORPORATE THE TOWN OF MILTON", THE CHARTER OF THE RELATING TO ITS NAME AND IMPACT FEES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend Section 1 Chapter 326, Volume 71, Laws of Delaware, by deleting at the end of the section “.” ” and inserting the following:
“ ”, named after John Milton, the English educator, poet, philosopher, and proponent of public education, democracy, and human rights.”
Section 2. Amend Section 29(a), Chapter 326, Volume 71 as amended, by adding a new sub-paragraph (a) (44) to read as follows:
“(44) May impose upon annexed property, new construction or new development “impact fees” that are reasonably calculated to recover the cost, and that have a rational relationship to such growth, of installing, enlarging, improving or expanding public or municipal improvements, including but not limited to sewer, water, roads, volunteer fire services, and/or library facilities.”
