AN ACT TO AMEND CHAPTER 13, TITLE 24 OF THE DELAWARE CODE RELATING TO REGULATION OF PRIVATE SECURITY AGENCIES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 1302, Title 24 of the Delaware Code by inserting after subsection (4) a new subsection (5) to read as follows:
"(5) ‘Computer forensic specialist’, means persons who interpret, evaluate, test, or analyze pre-existing data from computers, computer systems, networks, or other electronic media, provided to them by another person where that person owns, controls, or possesses said computer, computer systems, networks, or electronic media.".
Section 2. Redesignate subsections "(5)"through "(9)" as "(6)" through "(20)".
Section 3. Amend §1302(9) by striking the words "Investigations company" and inserting in lieu thereof "Investigator" before the words "or ‘agency"’.
Section 4. Amend §1302(9), Title 24 of the Delaware Code by adding a new subsection (f) as follows:
"(f) ‘Investigator’ or ‘agency’ shall not include any person employed as a computer forensic specialist.".
