AN ACT MAKING A SUPPLEMENTAL APPROPRIATION OF SIX MILLION FIVE HUNDRED THOUSAND DOLLARS FOR THE CREATION OF A PUBLIC EDUCATION CLASSROOM INSTRUCTION FUND, FOR THE PURCHASE OF INFLUENZA ANTIVIRALS AND TO SUPPORT THE HOUSING DEVELOPMENT FUND.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. There is hereby appropriated Six Million Five Hundred Thousand Dollars ($6,500,000) in General Funds. This Act is a supplemental appropriation and the funds herein appropriated shall be paid by the State Treasurer from General Fund monies not otherwise appropriated.

Section 2. Of the funds appropriated in Section 1 of this Act, Four Million One Hundred Thousand Dollars ($4,100,000) shall be allocated to the Department of Education (95-01-01) for a “Public Education Classroom Instruction Fund”. Such fund shall be administered by the Secretary of Education, with the approval of the Director of Office of Management and Budget and the Controller General, in accordance with the following provisions:

(a) Six Hundred Thousand Dollars ($600,000) shall be apportioned equally among all the State’s public school and charter school libraries. These funds shall be used to purchase library books and library materials.

(b) Three Million Five Hundred Thousand Dollars ($3,500,000) shall be allocated to the reorganized school districts and charter schools based on each district’s/charter’s proportionate share of September 30, 2005 certified Division I units. These funds may only be used to purchase textbooks and workbooks, additional library books and library materials, and instructional computer hardware and software.

(c) The funds allocated pursuant to this Section shall supplement the existing level of State and local expenditures in support of classroom instruction and library materials.

(d) In order that each district may benefit from maximum efficiency, delivery charges, and related complimentary materials, each district and charter school shall submit to the Department of Education, the Director of the Office of Management and Budget and the Controller General, a plan outlining specific proposed purchases. The Department of Education and the Office of Management and Budget shall offer to collaborate in negotiating such purchases. Funds shall be transferred to each district or charter school within 30 days of the receipt of the district or charter expenditure plan.

(e) No Fiscal Year 2006 or prior year expenditure may be recoded to this appropriation.

Section 3. Of the funds appropriated in Section 1 of this Act, One Million Four Hundred Thousand Dollars ($1,400,000) shall be allocated to the Department of Health and Social Service, Public Health, Community Health (35-05-20) for Influenza Antivirals. The intent of this appropriation is to be a state match to purchase antiviral courses from the U.S. Department of Health and Human Services, Centers for Disease Control and Prevention.

Section 4. Of the funds appropriated in Section 1 of this Act, One Million Dollars ($1,000,000) shall be allocated to the Delaware State Housing Authority (10-08-01) for the Housing Development Fund.

Section 5. Any funds herein appropriated shall not revert to the General Fund until June 30, 2007.
