AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE FILING OF FINANCIAL DISCLOSURE REPORTS AND CERTAIN OTHER DOCUMENTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §5812(n), Title 29 of the Delaware Code by inserting the designation "(A)" between "(n)" and " 'Public officer' shall mean:" at the beginning of subsection (n).

Section 2. Amend §5812(n), Title 29 of the Delaware Code by striking the phrase "National Guard." where it appears at the end of §5812(n)(17) and by substituting in lieu thereof:

"National Guard; and

(18) The Alcoholic Beverage Control Commissioner and the members of the Appeals Commission, pursuant to 4 Del. C. §306(c).".

Section 3. Amend §5812(n), Title 29 of the Delaware Code by striking the undesignated sentence, "Elected and appointed officials of political subdivisions of the State, public school districts of the State and state institutions of higher learning shall not be deemed to be public officers within the meaning of this subchapter.", where it appears at the end of subsection (n) and by substituting in lieu thereof the following: "(B) For purposes of this subchapter, the term 'public officer' does not include elected and appointed officials of political subdivisions of the State, of public school districts of the State, and of State institutions of higher learning.".

Section 4. Amend §5813(a), Title 29 of the Delaware Code by striking the phrase ", shall be notarized" where it appears in the second sentence of subsection (a).

Section 5. Amend §5813(b), Title 29 of the Delaware Code by striking the word "sworn" where it appears between "contain a" and "certification".

Section 6. Amend §5809(8), Title 29 of the Delaware Code by adding the following at the end of subsection (8): "The Commission may permit the filing of reports, statements, notices, and other documents by electronic means and may specify the form and content of such filings.".
