AN ACT TO AMEND CHAPTER 55, TITLE 15 OF THE DELAWARE CODE RELATING TO ABSENTEE BALLOTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend Chapter 55, Title 15 of the Delaware Code by inserting a new section therein to read:

Ҥ5525. Electronic delivery of absentee ballots.

(a) The provisions of this section apply to persons eligible to vote under the provisions of the federal Uniformed and Overseas Citizens Absentee Voting Act, as amended, 42 U.S.C. §§1973ff, et seq.

(b) Notwithstanding any other provisions of this Title, upon receipt of a written request on a federal post card application that includes an applicant’s electronic address, the Department of Elections for the County in which the applicant is domiciled (Department) shall electronically deliver to an applicant his/her absentee ballot, appropriate instructions and any other information the applicant needs to vote and return his/her ballot.

(c) The Department shall transmit to the applicant an absentee ballot, instructions and other necessary information within three business days following receipt of a request from an applicant. If ballots are not available when the Department receives this request, the Department shall transmit a ballot, instructions and other necessary information to the applicant within 5 business days after the ballots become available.

(d) An applicant who receives his/her ballot electronically shall return such ballot via U.S. air mail in accordance with the instructions sent with the ballot.

(e) The State Election Commissioner, in collaboration with the Department, shall create procedures for electronically delivering the absentee ballot, instructions for returning the ballots via U.S. air mail, and procedures for handling the ballots returned by mail to an applicant.”
