AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO PENSIONS FOR STATE POLICE OFFICERS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §8351(7), Title 11, of the Delaware Code, by inserting the phrase "or any 36 months comprised of 3 periods of 12 consecutive months" after the phrase "consecutive months".

Section 2. Amend Chapter 83, Title 11, Delaware Code by designating the current section 8375 as subsection (a) and adding a new subsection (b) to read as follows:

"(b) If the final average compensation of an employee has been reduced because of a leave of absence resulting from presidential determinations to augment active forces, such employee shall have their final average compensation adjusted by their amount of military compensation. This adjustment will be no greater then what the employee would have received had they remained in employment for the period of leave. The employee will contribute 7% of the amount that was adjusted."

Section 3. This Bill shall be effective retroactively to September 11, 2001.
