AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO SEX OFFENDERS AND SEXUAL OFFENSES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §779A(e)(1), Title 11 of the Delaware Code by inserting after the word "felony" and before the semicolon ";" the language "except where the child against whom a sexual offense is committed is a child younger than 12 years of age in which case the crime of sex offender unlawful sexual conduct against a child shall be a class C felony".
Section 2. Amend §779A(e)(2), Title 11 of the Delaware Code by inserting after the language "than the underlying offense" and before the semicolon ";" the language "except where the child against whom a sexual offense is committed is a child younger than 12 years of age in which case the crime of sex offender unlawful sexual conduct against a child shall be a class B felony".
