AN ACT TO AMEND TITLE 4 OF THE DELAWARE CODE RELATING TO FARM WINERIES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 512A(h), Chapter 5, Title 4, Delaware Code by inserting "or a temporary licensee not to exceed three (3) years" after the word "licensee" and before the words "shall be".

Section 2. Further Amend § 512A(h), Chapter 5, Title 4, Delaware Code by adding a new paragraph "(6)" to read as follows:

"(6) A temporary farm winery license may be issued, for not more than three (3) years, allowing the temporary licensee to operate according to (h)(1), (2) and (3) herein if all the licensing requirements have been met except for those required in § 543(g), Chapter 5, Title 4, Delaware Code, which requires government permitting to manufacture or ferment wine at the location. The temporary licensee shall, however, have obtained all necessary government permitting to operate as a temporary licensee.".
