AS AMENDED BY
HOUSE AMENDMENT NOS. 1 & 2
AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO EXPUNGEMENTS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 4373(a) of Title 11 of the Delaware Code by inserting after the phrase "Title 4, 7, 11, 16 or 23," the following language:
"or a county or municipal code, ordinance, or regulation which is the same as, or equivalent to, any Title 4, 7, 11, 16 or 23 offense,".
Section 2. Amend § 4373(c) of Title 11 of the Delaware Code by inserting between the word "crimes" and the punctuation ":" the following language:
", or any county or municipal code, ordinance, or regulation which is the same as, or equivalent to, any crime specified herein".
Section 3. Amend § 4374(a) of Title 11 of the Delaware Code by inserting after the phrase "commission of a crime" the following language:
", or a violation of any county or municipal code, ordinance, or regulation,".
Section 4. Amend § 4374(g)(1) of Title 11 of the Delaware Code by inserting after the phrase "set forth in Title 21" the following language:
", or in any county or municipal code, ordinance, or regulation which is the same as, or equivalent to, any Title 21 offense,".
Section 5. Amend § 4374(g)(2) of Title 11 of the Delaware Code by inserting between the phrase "Title 21 offenses" and the punctuation ":" the following language:
", or any county or municipal code, ordinance, or regulation which is the same as, or equivalent to, any Title 21 offense specified herein".
Section 6. Amend § 4375(b) of Title 11 of the Delaware Code by inserting between the phrase "the following crimes" and the punctuation ":" the following language:
", or any county or municipal code, ordinance, or regulation which is the same as, or equivalent to, any crime specified herein".
Section 7. Amend § 4376(a) of Title 11 of the Delaware Code by inserting after the phrase "the First Offenders Controlled Substance Diversion Program" the first time it appears therein the follow language:
"or a court-supervised drug diversion program".
Section 8. Further amend § 4376(a) of Title 11 of the Delaware Code by inserting between the phrase "§4764 of Title 16" and the punctuation "." the following language:
"or for participation in a court-supervised drug diversion program".
Section 9. Further amend § 4376(g) of Title 11 of the Delaware Code by inserting after the phrase "judgment disposition" the following language:
"or to participate in a court-supervised drug diversion program".
Section 10.
Amend § 4376(a) of Title 11 of the Delaware Code, effective as of September 1, 2011, by inserting after the phrase "the First Offenders Controlled Substance Diversion Program" the first time it appears therein the following language:
"or a court-supervised drug diversion program".
Section 11. Further amend § 4376(a) of Title 11 of the Delaware Code, effective as of September 1, 2011, by inserting between the phrase "§ 4767 of Title 16" and the punctuation "." the following language:
"or for participation in a court-supervised drug diversion program".
Section 12. Further amend § 4376(g) of Title 11 of the Delaware Code, effective September 1, 2011, by inserting after the phrase "judgment disposition" the following language:
"or to participate in a court-supervised drug diversion program".
