AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOUSING.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend section 7011, Title 25 of the Delaware Code by deleting existing subsection (a) in its entirety and substituting in lieu thereof the following:
"(a) The Authority shall be administered by a board of directors (Board) made up of the following five (5) voting members: one (1) member who is appointed by the Governor from a list of at least two (2) nominees submitted by the largest not-for-profit association representing manufactured home owners in the State; one (1) member who is appointed by the Governor from a list of at least two (2) nominees submitted by the largest not-for-profit association representing the manufactured home industry in this State; one (1) member who is appointed by the Governor from the public-at-large; one (1) member who is appointed by the Speaker of the House of Representatives; and one (1) member who is appointed by the President Pro Tempore of the Senate. One (1) non-voting member shall be appointed by the Attorney General, as a representative of the Consumer Protection Unit of the Justice Department, but none of the last three (3) members listed above shall be a landlord, community owner, home owner, or tenant. All Board members shall be residents of the State of Delaware, and such members shall serve at the pleasure of the authority that appointed such member.
The terms of the members shall
be staggered so that no more than two (2) members’ terms end at the same time
. The first two (2) appointees shall serve for a term of one (1) year, the next two (2) appointees shall serve for a term of two (2) years, and the remaining one (1) appointee shall serve for a term of three (3) years. Thereafter, all appointees shall serve for a term of two (2) years; provided, however, that a member may be appointed for a term of less than two (2) years to ensure that the Board members' terms expire on a staggered basis

The
term for any member of the Board may subsequently be renewed for an additional term or additional terms. The Governor shall designate one (1) member of the Board as the chairperson of the Board.".
Section 2. Amend section 7011(b)(4), Title 25 of the Delaware Code by deleting "75% of the" and substituting in lieu thereof "at least 3 of the 5".
Section 3. Amend section 7011(c)(3), Title 25 of the Delaware Code by deleting "a minimum of 75% of the" and substituting in lieu thereof "at least 3 of the 5".
Section 4. This Act shall take effect 90 days after it is enacted into law.
