AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO THE BOARD OF DENTISTRY AND DENTAL HYGIENE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Title 24, § 1133(5) of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§ 1133 Exemptions.
Nothing in this chapter shall be construed to prevent:
(5) A person otherwise qualified under this chapter from rendering dental services in A person not currently licensed as a dentist under this chapter from owning or operating a nonprofit, tax-exempt organization as described in §§ 501(c)(3), 509(a)(1) and 170(b)(1)(A)(iii) of the Internal Revenue Code [26 U.S.C. §§ 501(c)(3), 509(a)(1), and 170(b)(1)(A)(iii)] that does not charge for its services and is affiliated with a hospital, licensed by the Department of Health and Social Services, and accredited by the Joint Commission on Accreditation of Hospitals or the American Osteopathic Association so long as such person is not otherwise practicing dentistry.
