DELAWARE STATE SENATE

144th GENERAL ASSEMBLY

SENATE CONCURRENT RESOLUTION NO. 42

URGING THE WILMINGTON CITY COUNCIL TO APPROVE FUNDING FOR MAYOR JAMES BAKER'S PROPOSAL TO CREATE A EMERGENCY SIDEWALK FUND TO ADDRESS THE CURRENT CONDITION OF SIDEWALKS IN THE CITY OF WILMINGTON.

WHEREAS, Mayor Baker and the City of Wilmington have taken the initial steps to address the long neglected sidewalk situation in Wilmington; and

WHEREAS, the issue of sidewalk responsibility has long been debated without resolution; and

WHEREAS, the City of Wilmington’s Charter clearly states that sidewalks are the responsibility of the City and not its residents; and

WHEREAS, in recognizing the public safety issue for pedestrians in the City of Wilmington represented by sidewalks, many members of the State Legislature have contributed millions of dollars for the repairs and replacements of thousands of square feet of city sidewalk over the last twenty years; and

WHEREAS, with this generous support new sidewalks have been constructed for many homeowners in the City of Wilmington; and

WHEREAS, a City-supported sidewalk fund would go a long way towards maintaining the sidewalks which pedestrians use and depend on everyday; and

WHEREAS, the mayor’s proposed emergency sidewalk fund reflects a new policy commitment from the City of Wilmington and the City Council towards pedestrian safety.

NOW THEREFORE:

BE IT RESOLVED by the Senate of the 144th General Assembly of the State of Delaware, the House of Representatives concurring therein, that the members do hereby support Mayor James Baker’s emergency sidewalk fund proposal for the City of Wilmington, for purposes of repairing and replacing neglected and hazardous sidewalks throughout the City of Wilmington.

BE IT FURTHER RESOLVED that suitably prepared copies of this resolution be delivered to the Mayor of the City of Wilmington, and all members of City Council.
