SENATE BILL NO. 265

AN ACT DEAUTHORIZING CERTAIN PROJECT BALANCES TO THE GENERAL FUND AND DEPOSITING CERTAIN FUNDS OF THE STATE TO THE GENERAL FUND.

Section 1. Deposit of Interest Earned on Special Funds to the General Fund. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, the sum of $5,070,400.00 in interest earned from the account listed herein shall be transferred to appropriation 2008-10-02-11-8400 (Reductions) and deposited into the General Fund for Fiscal Year 2008:

Section 2. Deposit of Special Funds to the General Fund. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, the sum of $587,913.05 in appropriation 2008-25-01-01-8001 (Clean Water State Grant) and $300,000.00 in appropriation 2008-40-06-04-8210 (Land and Water Conservation Fund Project) shall be transferred into appropriation 2008-10-02-11-8400 (Reductions) and deposited into the General Fund for Fiscal Year 2008.

Section 3. General Fund Project Deauthorizations. Notwithstanding the provisions of any other State law, the State Treasurer hereby deauthorizes the remaining appropriation balances, not in excess of the balances listed below, from the following projects and authorizes the transfer of said funds into appropriation 2006-10-02-11-0200 (Reductions) or 2007-10-02-11-0200 (Reductions), whichever is applicable, for reversion to the General Fund during Fiscal Year 2008.

Section 4. Community Redevelopment Fund Projects. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, up to $546,087.85 in completed projects funded from prior year Community Redevelopment Funds within the Office of Management and Budget, Administration (10-02-05) shall be transferred into appropriation 2008-10-02-11-8400 (Reductions) and deposited into the General Fund for Fiscal Year 2008.

Section 5. Resource, Conservation and Development Projects. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, up to $2,262,600.00 in completed Resource, Conservation and Development projects within the Department of Natural Resources and Environmental Control, Soil and Water Conservation, Drainage and Stormwater (40-07-02) shall be transferred into appropriation 2008-10-02-11-8400 (Reductions) and deposited into the General Fund for Fiscal Year 2008.

Section 6. Severability Clause. If any section, part, phrase, or provision of this Act or the application thereof be held invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the section, part, phrase, provision, or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Act or the application thereof.
