AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO THE SALE OF MOTOR VEHICLES.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 


                Section 1.  Amend § 6309, Title 21 of the Delaware Code by adding a new subsection (e) to read as follows:

                "(e)         A dealer or an agent or employee of a dealer may not sell a motor vehicle with tinted windows in violation of § 4313 of Title 21.".


SYNOPSIS

This legislation makes it illegal for a dealer to sell a motor vehicle with tinted windows that are in violation of Delaware law.  A few dealers are currently selling vehicles taken in trade with illegally-tinted windows.  This subjects a vehicle buyer, who may not realize the window tint is illegal, to arrest due to this violation of Title 21.  In addition, the buyer has to pay to have the window tint removed when the vehicle fails inspection.
