AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO TINTED WINDOWS.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

 

Section 1.  Amend §4313 of Title 21 of the Delaware Code by inserting a new subsection "(F)" to read as follows:

"(F)  This section shall not apply to any surveillance vehicles operated by a police officer, as defined under §8401(5) of Title 11 of this Code.  This exception shall not apply to marked vehicles, or those unmarked vehicles used primarily for regular duty patrols."

Section 2.  The Division of Motor Vehicles and any agency owning vehicles the agency wishes to qualify under this exception to the tinting requirements of the Code shall coordinate to create an effective method to identify those surveillance vehicles and avoid confusion during the safety inspection process.

Section 3.  This Act shall take effect immediately upon signing by the Governor.


 

 

SYNOPSIS

This Act exempts surveillance vehicles used by police officers from the limitation on tinting of vehicle windows.  For purposes of this Act, "police officer" includes all of those defined as such under the Delaware Police Training Program in Chapter 84 of Title 11 of the Delaware Code.  That definition includes full-time Department of Natural Resources and Environmental Control officers.
