SENATE BILL NO. 230

AN ACT TO AMEND TITLES 1, 14, 16, 29, AND 30 OF THE DELAWARE CODE CREATING A NEW DIVISION WITHIN THE DEPARTMENT OF ADMINISTRATIVE SERVICES BY COMBINING THE POWERS AND DUTIES OF THE DIVISION OF SUPPORT OPERATIONS AND THE DIVISION OF PURCHASING AND RENAMING THE NEW DIVISION "THE DIVISION OF SUPPORT SERVICES."

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §108, Title 1 of the Delaware Code by striking the phrase "Division of Purchasing" and substituting in lieu thereof the phrase "Division of Support Services" wherever it is found in said section.

Section 2. Amend §220, Title 1 of the Delaware Code by striking the phrase "Division of Purchasing" and substituting in lieu thereof the phrase "Division of Support Services" wherever it is found in said section.

Section 3. Amend §4203(5), Title 14 of the Delaware Code by striking the phrase "Division of Purchasing" and substituting in lieu thereof the phrase "Division of Support Services" in said paragraph.

Section 4. Amend §§9603 and 9604, Title 16 of the Delaware Code by striking the phrase "Director of Purchasing" and substituting in lieu thereof the phrase "Director of the Division of Support Services" wherever it is found in said sections.

Section 5. Amend §§6505, 6901, 6902, 6906, 7002, 8803, 8810 and 8814, Title 29 of the Delaware Code by striking the phrase "Division of Purchasing" and substituting in lieu thereof the phrase "Division of Support Services" wherever it appears in said sections.

Section 6. Amend §§6505, 6906, 7105 and 8812, Title 29 of the Delaware Code by striking the phrase "Division of Support Operations" and substituting in lieu thereof the phrase "Division of Support Services" wherever it appears in said sections.

Section 7. Amend §8803(2)(f), Title 29 of the Delaware Code by striking said subsection in its entirety.

Section 8. Amend §8804(7), Title 29 of the Delaware Code by striking the phrase "Director of Purchasing" and substituting in lieu thereof the phrase "Director of the Division of Support Services" in said paragraph.

Section 9. Amend §8804(8), Title 29 of the Delaware Code by striking said subsection in its entirety.

Section 10. Amend §8810, Title 29 of the Delaware Code by striking subsection (h) of said section and by substituting in lieu thereof the following:

"(h) The Division of Support Services shall provide messenger and mail services to state agencies.

    1. The Division of Support Services shall provide graphics and printing services, including but not limited to, printing, duplicating, photography and photocopying, to all state agencies

    1. The Division of Support Services shall provide transportation services to state agencies through the Office of Fleet Services.

    2. The Division of Support Services shall provide information services to the general public through a State Information Guide System.

    3. No agency of state government shall procure, purchase or lease any postage meters or equipment for the metering of mail or the affixing of postage without the prior approval of the Division of Support Services.

    4. The Division of Support Services shall assume such other powers, duties and functions as the Secretary may assign which are not otherwise inconsistent with the laws of this State."

Section 11. Amend §8810(d), Title 29 of the Delaware Code by inserting the phrase, "procure or purchase" after the phrase "contract for" and before the phrase "printed matter." in said subsection.

Section 12. Amend Chapter 88, Title 29 of the Delaware Code by deleting §8811 in its entirety and renumbering the remaining sections of said chapter accordingly.

Section 13. Amend §2901(2)(b)(vii), Title 30 of the Delaware Code by striking the phrase, "Division of Support Operations" and substituting in lieu thereof the phrase "Division of Support Services" in said subparagraph.

SYNOPSIS

This Bill consolidates the powers and duties of the Division of Purchasing and the Division of Support Operations into one new division. The Bill also renames the new Division, the "Division of Support Services" and ensures that the name change is reflected throughout the Code.
