HOUSE AMENDMENT NO. 6

TO

HOUSE BILL NO. 190

AMEND House Bill No. 190 at line 138 by inserting after “ statutes ” and before the period the following: “ , and shall agree to pay all costs of such compliance ”.

FURTHER AMEND House Bill No. 190 by striking line 145 inserting in lieu thereof the following:

(8) Evidence of financial assurances in sufficient form and amount necessary to ensure that (i) there are sufficient resources for all costs of compliance with the Delaware Hazardous Substances Control Act and other relevant state and federal environmental statutes concerning contamination on the site at the time of application; and (ii) upon the event of ”.

SYNOPSIS

This amendment clarifies that new owners, operators, or prospective purchasers are by default responsible for covering ongoing costs of compliance with environmental statutes relating to pre-existing contamination.
