HOUSE BILL NO. 190

AMEND House Bill No. 190 at line 148 by inserting after “ site ” and before the period the following: “ in accordance with a concept plan that will be approved by the Department of Natural Resources and Environmental Control as part of the conversion permit. A final plan approved by the Department of Natural Resources and Environmental Control is required prior to the initiation of operation of the activity being authorized under the conversion permit ”.

SYNOPSIS

This amendment establishes that to demonstrate financial assurance regarding the ability to prevent or contain and remediate environmental contamination, a conversion permit applicant must submit a concept plan to DNREC for approval. After issuance of a conversion permit, the permit holder will be required to submit a final plan prior to beginning operations authorized by the permit.
